Did Disney Steal This Alice In Wonderland Image?

Three things I learned:
1.) That Disney would take something that isn't there's,

2.) That Disney would do this without permission.

3.) That there could have been multiple reasons as to why Disney screwed up here.

Two opinions:
1.) It seems as though Disney finds themselves to be invincible because they are so huge.

2.) It's annoying how when big name companies make mistakes there are usually no repercussions against them.

Question:
1.) If Disney does get penalized for this, what would be the penalization? A fine? Yeah...that'll teach them (obvious sarcasm is obvious).
